Don’t worry – we’re not going to get all heavy on you.
But this is one of several posts we are going to write to make sure you are protected and operating within the legal guidelines.
Although it is not a replacement for seeking individual legal advice for your business.
If you are based in the UK, and use a third provider for your email marketing, such as MailChimp, you should be registered with the Information Commissioner’s Office for Data Protection.
Visit this website: www.ico.org.uk (we have added the link to take you directly to the right place). Go ahead and register using either the PDF or Word version of the form.
Note: if you do use an email provider you need to say yes to sharing information with third parties outside of the EU (MailChimp is based in the US)
Once you have emailed it over to the ICO, it only takes a short while for them to respond. The charge is £40 annually – which is significantly less than being fined for non registration!
Be sure to check the form when it comes back to you to make sure it accurately reflects what you do with the information – in most cases marketing.
If you are in any doubt, please consult a professional – getting legal advice is cheaper than finding yourself on the wrong side of the law.
